Privacy Policy

Fight4Balance Ltd (ABN 30 631 804 334) (‘Fight4Balance’ or ‘we’, ‘us’, ‘our’) treats protection of the privacy of your personal information as a primary concern. This policy informs you about the types of information we collect and hold about you and how we use that information.

Personal information is information or an opinion that identifies a person or from which a person can reasonably be identified. It includes information such as your name, address, date of birth, contact details and emergency contact details. It may also include ‘ sensitive information’, including ‘health information’, such as information about any medical conditions you may have, medical history, and treatment and advice from healthcare professionals.


Personal information we collect

Fight4Balance is a registered charitable organisation that delivers adaptive sport, functional health and community inclusion programs to adolescent youth with learning and perceptual disabilities, and their families. 

We collect personal information that is reasonably necessary for our functions or activities as a charitable, fundraising organisation and to provide our programs and support. Where the personal information relates to a child or minor (ie someone under the age of 18, which could include an All Star, Buddy or sibling of an All Star or Buddy), a parent or guardian for that child or minor will be asked to provide the relevant information for the child or minor and is taken to accept the collection and use of the information in accordance with this policy on behalf of the child or minor.

The types of personal information we generally collect includes your name, gender, date of birth, address and other contact details such as your telephone number and email address. We may collect other information about you as reasonably necessary for the purposes of your interactions with us. This may include the types of personal information listed below.

For our programs: If you want to participate in our programs (either as an All Star or Buddy, parent or guardian of an All Star or Buddy, or a sibling of an All Star or Buddy), the additional types of personal information we may collect include:

  • Sensitive information about your or your child’s health and any medical conditions you or your child may have, including information about any mental health, physical and other conditions (verified or unverified including cognition), diagnosis, medical plans, treatment and advice from healthcare professionals. This is so we can assess your suitability for various programs, and the way those programs may be delivered to you.
  • Bank, credit card or other payment processing information for any fees (if any) that may be associated with participating in our programs.
  • Your image, video and sound recordings. We may use this information on our Facebook page or in other promotional materials, but only if you give us your consent as part of the enrolment process for participation in our programs. Otherwise, we will not use this type of information in a way that identifies you.

Prospective volunteers and contractors: If you want to be a volunteer to assist in managing and delivering any of our programs and activities (for example, if you want to be a volunteer to assist in managing and delivering one or more of our programs), the additional types of personal information we may collect include:

  • Information that you give us as part of the process for your application to become a Fight4Balance volunteer or contractor;
  • Information we may collect from third parties, such as from referees you give us. By providing us with contact details for your referees or other third parties you are taken to have given consent to us contacting and collecting information about you from them.
  • Information we may obtain from relevant Government Agencies (for example, any police checks and information in relation to ‘Blue Cards’ to work with minors).
  • Sensitive information about your health and any medical conditions you may have, including information about any mental health, physical and other conditions, and treatment and advice from healthcare professionals, in relation to assessing your ability and suitability to perform the requirements of the role.
  • If your position involves any payment by Fight4Balance to you, we may also collect your tax file number, bank account and other payment details.
  • Your image, video and sound recordings. We may use this information on our Facebook page or in other promotional materials, but only if you give us your consent. Otherwise, we will not use this type of information in a way that identifies you.

Fundraising and support: If you make a donation to us or otherwise make payments to us for fundraising purposes, the additional types of personal information we may collect include:

  • Bank, credit card or other payment processing information for the purposes of processing your donation or fundraising payment.
  • Contact information for the purposes of providing a receipt and/or contacting you

Fight4Balance will generally only collect personal information, including health information, directly from you. In some circumstances, we may seek your consent to speak with your treating medical practitioners to ensure that we are providing appropriate and constructive support. You may withdraw your consent for Fight4Balance to retain your health information or to contact your treating medical practitioner at any time.

You are liberty not to identify yourself or provide any of your personal information to us. However, this may limit the extent to which we may be able to involve you in our programs or engage with you, for example as a volunteer or contractor or as a participant in one of our programs.




The purposes for which we use and disclose personal information

Fight4Balance will only use and disclose your personal information for the primary purpose for which it was collected and for directly related purposes that you would reasonably expect (for example, to verify your identity when you attend a program for which you have registered). In relation to our main activities, in addition to the purposes set out above, Fight4Balance may use and disclose your personal information for the following purposes:


  • Where you are involved in one of our programs, Fight4Balance will use and disclose your personal information to assess whether you can undertake our programs and to facilitate providing our program(s) to you. For example, we may disclose your information to health service professionals who may be involved in our programs that you are participating in.
  • Where you are a volunteer or contractor involved in delivering our programs, we will use and disclose your personal information to assess your ability and suitability to be involved in our programs, and to facilitate your involvement in helping to deliver our programs.
  • Where you have made a donation or other fundraising payment, we will use and disclose your personal information in order to process your donation or payment.
  • If you have given your consent, we may also use your personal information to send you marketing information about future programs you may be interested in, and opportunities to support us through donations and other fundraising.

From time to time Fight4Balance may use and disclose de-identified, aggregated or statistical data related to our programs and activities for research purposes, including research that may help to guide service quality improvement and development. Fight4Balance may partner with third party research organisations, such as universities, and other third parties in relation to such research. Fight4Balance will not under any circumstances disclose your personal information to a third party for research or other purposes unless we have your express written consent to do so.


Disclosure to third parties

Fight4Balance uses some third party service providers to operate, for example third party IT service providers. Where reasonably necessary, we may disclose your personal information to those third party service providers (for example, for the electronic storage of data or information). However, where we do so, we will use our best endeavours to ensure that the third party agrees to implement appropriate privacy protections around the handling and use of that information.


Disclosure overseas

Fight4Balance generally does not disclose personal information to overseas recipients. Unless we have your consent, or a relevant exception applies under any applicable law, we will only disclose your personal information to overseas recipients where we have taken reasonable steps to ensure that the overseas recipient complies with any relevant and applicable Australian privacy laws.

Website and email

If you visit our Website to read, browse or download information, our system may record information such as the date and time of your visit to the Website, the pages accessed and any information downloaded. This information is used for statistical, reporting and website administration and maintenance purposes and it is not used to identify you.

Like many other websites, our Website may use ‘cookies’ from time to time. A cookie is a piece of information that allows our system to identify and interact more effectively with your device. The cookie helps us to maintain the continuity of your browsing session and remember your details and preferences when you return. You can configure your web browser software to reject cookies however some parts of our Website may not have full functionality in that case.

If you are considering sending us any other personal information through our Website or other electronic means, please be aware that the information may be insecure in transit, particularly where no encryption is used (e.g. email, standard HTTP).

Our Website may contain links to third party websites. Fight4Balance does not endorse the content of those third party websites. Fight4Balance recommends that you review the privacy policy of any such third party websites, and make a decision about whether a website is helpful to you.

Security of personal information

Fight4Balance securely stores personal information that it does collect electronically and in hard copy form. In either case, we implement a range of measures to protect the security of personal information. We also take steps to destroy or permanently de-identify personal information when no longer needed for a permitted purpose.

Access, correction, complaints and further information

If you wish to obtain access to, request the correction or removal of personal information held about you by Fight4Balance, you can contact Fight4Balance’s [Chief Executive Officer] as set out below.

Fight4Balance takes your privacy concerns seriously. If you express any concern that Fight4Balance has interfered with your privacy, we will respond to you to let you know who will be handling your matter and when you can expect a further response.
